Terms of Service

You must be at least 18 years old to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at support@profithawk.pro if you believe your account has been compromised. We are not liable for losses caused by unauthorized account access resulting from your failure to safeguard your credentials.

You may not share accounts, create accounts using automated means, or impersonate another person or entity.

You agree to use the Service only for lawful purposes related to bookkeeping, accounting, and financial tracking for your own resale business. You agree not to:

• Use the Service to facilitate tax fraud, money laundering, or any illegal activity
• Attempt to gain unauthorized access to the Service or any other system
• Reverse-engineer, decompile, or copy any part of the Service
• Scrape, crawl, or bulk-download data through automated means without our written consent
• Resell or sublicense the Service to third parties without our written consent
• Upload malicious code, viruses, or any content that could harm the Service or other users

We reserve the right to suspend or terminate accounts that violate these rules without prior notice.

The Service is offered on a subscription basis. Current pricing is listed at /pricing. Prices are in US dollars and do not include applicable taxes, which will be added where required by law.

Subscriptions renew automatically at the end of each billing period (monthly or annual) unless you cancel before the renewal date. You can cancel at any time from your account settings. Cancellation takes effect at the end of the current billing period — we do not issue prorated refunds for partial periods, except where required by law.

We offer a 14-day free trial. No credit card is required to start a trial. At the end of the trial period, you may choose to subscribe by entering payment information, or your account will be limited to read-only access. Trial accounts that are not converted to a paid subscription within 90 days of trial expiry may be deleted along with their data — we will send you email notice before deletion.

We reserve the right to modify or discontinue the free trial offer at any time. One free trial per person or organization — creating multiple accounts to circumvent this limit is not permitted.

You may cancel your subscription at any time. After cancellation, your account enters a 90-day read-only grace period during which you can export your data. After 90 days, your data will be deleted. We recommend exporting your records before cancelling.

To delete your account immediately (before the grace period ends), contact us at support@profithawk.pro. Immediate deletion is irreversible.

You own your data. We claim no intellectual property rights over the financial records, inventory data, or reports you generate using the Service. You grant us a limited license to process your data for the purpose of providing the Service to you.

We are a data processor for the financial data you connect via eBay and other platforms. Our handling of that data is described in our Privacy Policy.

The Service, including its software, design, trademarks, and content (excluding your data), is owned by Profit Hawk and protected by applicable intellectual property laws. These Terms grant you a limited, non-exclusive, non-transferable license to use the Service for your internal business purposes during the term of your subscription.

The Service integrates with third-party platforms including eBay, payment processors, and AI services. Your use of those platforms is governed by their own terms and policies, which we do not control. We are not responsible for the availability, accuracy, or conduct of third-party services. If a third-party API changes or becomes unavailable, features that depend on it may be affected.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Profit Hawk is a bookkeeping tool — it is not a licensed tax advisor, CPA, or financial advisor. Reports and exports generated by the Service are for your informational use and should be reviewed by a qualified tax professional before being relied upon for tax filings or other legal purposes. We do not guarantee the accuracy or completeness of data synced from third-party platforms.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PROFIT HAWK BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100 USD.

These Terms are governed by the laws of [STATE], without regard to its conflict-of-law provisions. Any dispute arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by a recognized arbitration body under its rules, except that either party may seek injunctive relief in a court of competent jurisdiction for intellectual property violations.

You waive any right to participate in a class action lawsuit or class-wide arbitration.

We may update these Terms from time to time. We will notify you of material changes by email and by updating the “Last updated” date. Your continued use of the Service after the effective date of any changes constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service and may cancel your account.
